Terms of Use
These Terms of Use (the Terms) are the agreement and end-user licence between you and Cayman Pty Ltd (we, us, our) for the Chart Reps mobile app and website (the App). By downloading, creating an account, or using the App, you agree to these Terms. If you do not agree, do not use the App.
Chart Reps is an educational simulator for practising chart reading. It uses historical market data for training only. Nothing in the app is financial, investment, or trading advice. There is no real money, no real trades, and no brokerage — outcomes are deterministic evaluations of past price data. Past performance does not predict future results.
1Licence to use the App
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own non-commercial practice. This licence is subject to these Terms and, where you install through the App Store, to Apple's Licensed Application End User License Agreement (the standard Apple EULA), which applies in addition to these Terms. Where the two conflict, the stricter provision protecting your rights under applicable law prevails.
2Acceptable use
You agree not to:
- copy, modify, reverse-engineer, decompile, or create derivative works from the App, except to the extent this restriction is prohibited by law;
- resell, sublicense, rent, or commercially exploit the App or your access to it;
- attempt to gain unauthorised access to the App, other accounts, or our systems, or interfere with their normal operation;
- use the App in any way that breaches applicable law or these Terms.
3Your account
You can use Chart Reps as a guest, in which case your practice records stay on your device. To save and sync your record you create an account, with an email address and password or with Sign in with Apple. You are responsible for keeping your login credentials secure and for activity under your account. Tell us promptly at [email protected] if you suspect unauthorised use. You can delete your account at any time from within the App or by contacting us; see the Support page for steps. How we handle your personal information is set out in our Privacy Policy.
4Not financial advice
Chart Reps is an educational simulator. It uses historical market data so you can practise reading charts. Nothing in the App is financial, investment, or trading advice, a recommendation, or an offer to buy or sell any financial product. The App does not handle real money, execute real trades, or provide brokerage or live market data to act on; every outcome is a deterministic evaluation of past price data. Past performance does not predict future results. You are solely responsible for any real-world financial decisions you make, and you should obtain advice from a licensed professional before making them.
5Subscriptions
Some features of the App require a paid subscription, sold as an auto-renewable in-app subscription through your Apple ID. The following terms apply to every subscription.
- What you get and what it costs
- The subscription name, the features it includes, the price, and the subscription period (for example, monthly or annual) are shown on the purchase screen in the App before you confirm, in your local currency. Current offering: Chart Reps Pro — US$9.99 per month, or US$79.99 per year.
- Auto-renewal
- Your subscription automatically renews for the same period at the then-current price unless you cancel it. Payment is charged to your Apple ID at confirmation of purchase and again at the start of each renewal period. Your subscription renews unless you turn off auto-renewal at least 24 hours before the end of the current period.
- Managing and cancelling
- You can manage or cancel your subscription, and turn off auto-renewal, at any time in your Apple ID settings (Settings → your name → Subscriptions on iOS). Cancelling stops the next renewal; you keep access until the end of the period you have already paid for. The Support page has step-by-step instructions.
- Free trials and introductory offers
- If a free trial or introductory offer is available, its length and terms are shown on the purchase screen ([[TRIAL_AND_INTRO_TERMS]]). If you buy a subscription during a free trial, any unused portion of that trial is forfeited when the purchase begins. If you do not cancel before a free trial ends, it converts to a paid subscription at the disclosed price.
- Restoring purchases
- If you reinstall the App or use a new device signed in to the same Apple ID, you can restore an active subscription using the Restore Purchases option in the App.
- Payment is handled by Apple
- All billing is processed by Apple through your Apple ID. We do not receive or store your payment card details. Refunds are handled by Apple in accordance with the App Store terms and applicable law.
6Intellectual property
The App, including its software, design, brand, and content (other than your own records), is owned by us or our licensors and is protected by intellectual property laws. These Terms do not transfer any ownership to you beyond the limited licence in section 1.
7Your content
Your rep and performance records are yours. By using the App you grant us the limited permission needed to store, sync, and display those records back to you as part of providing the service. We do not sell your records or use them for advertising (see the Privacy Policy). When you delete your account, your synced records are permanently removed.
8Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a replacement or refund and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods or services repaired or replaced if they are not of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
9Liability
Subject to section 8, and to the maximum extent permitted by law: the App is provided on an "as is" and "as available" basis; we do not warrant that it will be uninterrupted or error-free; and we are not liable for any indirect, incidental, or consequential loss, or for any trading, investment, or other financial decision you make. Because Chart Reps provides no financial advice and executes no real trades (section 4), it is not responsible for real-world financial outcomes. Where our liability cannot be excluded but can be limited, it is limited, at our option, to resupplying the service or paying the cost of having it resupplied.
10Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms or use the App unlawfully. On termination, the licence in section 1 ends; sections that by their nature should survive (including sections 4, 6, 8, 9, and 11) continue to apply.
11Governing law
These Terms are governed by the laws of Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Australia. This does not deprive you of the protection of any mandatory consumer law of the place where you live.
12Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date above and, where the change is material, take reasonable steps to notify you. Continuing to use the App after a change takes effect means you accept the updated Terms.
